UK ILR rules make 10 years the standard wait for settlement - what changes
New UK ILR rules make 10 years the standard wait for settlement, with 3 or 5 years for high earners and key workers. What changes for Pakistanis in the UK.
The UK's new ILR rules make 10 years the standard wait for settlement, double the 5 years most work visa holders have relied on until now. The Home Office set out the "earned settlement" plan before Parliament on 2 November 2026, with shorter routes of 3 or 5 years for high earners and some public service workers.
This matters to the large Pakistani community in Britain, including skilled workers, care workers, students who switched to work visas and their families. Settlement, known as indefinite leave to remain (ILR), is the step that gives full access to the job market, the NHS and the welfare system, and it usually comes before British citizenship.
What are the new UK ILR rules?
The government's announcement and a summary by the Electronic Immigration Network (EIN) set out these qualifying periods:
| Wait for settlement | Who it applies to |
|---|---|
| 3 years | Top earners: £125,141 or more for 3 years (or 3 of the last 4), or the highest talent group |
| 5 years | Earned £50,271 or more for 3 of the last 5 years; 5 years in an eligible public service job such as doctor, nurse or teacher; or a British connection |
| 10 years | The standard route. Earnings of at least £12,571 for 5 of the previous 7 years |
| 20 years | People with immigration rule breaches, or whose use of public funds blocks an earlier route |
Refugees have separate routes. Those on Home Office-approved resettlement schemes can settle in 5 years, while others face 10 or 20 years, and up to 30 years for people who arrived by small boat or another illegal route.
What conditions must every applicant meet?
Whatever the route, the Home Office says all applicants will need:
- A clean criminal record. This replaces the current threshold of a 12-month suspended sentence.
- A high standard of English, described as equivalent to A-Level English as a foreign language.
- No debt owed to the taxpayer.
- A sustained record of National Insurance contributions. EIN reports this as at least three years.
People who have claimed benefits will need five continuous years without public funds before they apply.
Do the new settlement rules apply to people already in the UK?
Yes, in most cases. The Home Office says the rules apply at the point of application, regardless of when someone arrived. It estimates that more than 500,000 people will now wait longer than 5 years to settle.
There are important protections:
- Anyone who already has settled status keeps it. It will not be removed.
- No one will be forced to leave, the government says. People on the 10-year path can keep renewing their current visas until they qualify.
- Family members of British citizens, Hong Kong BN(O) holders, members of the armed forces and Windrush cases keep their current routes.
What happens to care workers and NHS staff?
Care workers who met their visa conditions, including earning at least £25,000 a year in the sector, keep the 5-year route. Around a quarter of the roughly 250,000 people who joined the care route between 2022 and 2025 did not meet those conditions. They can apply for a further 5-year care visa, are not tied to their old employer and will get help to find a legitimate provider.
Some public sector workers in health and education, such as auxiliary nurses, get similar treatment. These concessions apply only to people who joined their routes before the Immigration White Paper of May 2025.
When do the changes start?
According to EIN, the changes begin with the December Immigration Rules and will roll out over 2027. The Home Secretary said impact assessments and guidance will be published as each part is introduced. Families should check GOV.UK for the detailed rules on dependants.
What it means for Pakistan
For Pakistanis in the UK, the biggest change is time. A worker earning below £50,271 who expected to settle after 5 years should now plan for 10, with visa renewal fees and the Immigration Health Surcharge paid along the way.
Illustration only: at about Rs371 to the pound, the £50,271 threshold for the 5-year route equals roughly Rs18.65 million a year, and the £25,000 care-worker threshold about Rs9.28 million. Check today's pound rate on our rate tracker.
Steady jobs abroad also support remittances, which are a key source of foreign exchange for Pakistan, as our remittances guide explains. A longer path to settlement may change how some families plan savings and moves.
What to do now:
- Do not panic: settled status already granted is safe, and nobody is being asked to leave.
- Keep your record clean: pay any NHS, tax or council debts and avoid breaking visa conditions, as breaches can push settlement to 20 years.
- Work on your English: the higher standard will apply to everyone.
- Keep payslips and National Insurance records to prove earnings for the 3- or 5-year routes.
- Use only official sources or regulated advisers: check GOV.UK, and in the UK use advisers regulated by the Immigration Advice Authority. Never pay agents who promise quick settlement.
